This Refund Policy explains when members of Apex Circle (β€œApex”, β€œwe”, β€œus”, β€œour”) are eligible for refunds and how cancellations are handled. By purchasing a membership or participating in Apex Circle, you agree to this policy.

‍1. General Refund Principle

Apex Circle operates as a membership-based community, not an event-by-event booking platform.
Membership fees cover access to the community, monthly matching, coordination, and operational costs.
‍For this reason, all membership fees are generally non-refundable.
‍
Refunds are only provided where required by applicable law.

‍2. Membership Fees2.1 Non-Refundable Fees

All membership fees β€” monthly, quarterly, annual, or pilot program β€” are non-refundable, including when:
- You choose not to complete your monthly activity
- You cannot attend your squad’s event
- Your schedule changes
- You forget to fill in your monthly availability
- You move cities or countries and do not notify us prior to the matching deadline
- You are not matched in a given month due to limited availability
- You cancel before the end of your active billing cycle

Membership benefits remain accessible until the end of your current paid period.

‍3. Automatic Renewals
‍
Memberships renew automatically unless cancelled before the renewal date.
If you forget to cancel your membership before renewal, this does not qualify for a refund.

You may cancel at any time via:
- Your billing portal in Stripe
- Emailing us
‍
Your membership will remain active until the end of the current billing cycle.

‍4. If Apex Circle Cancels an Activity
‍
Apex occasionally collaborates with external partners for activities.
‍
If an activity is cancelled due to:
- Weather
- Venue issues
- Illness of instructors
- Operational constraints
- Partner cancellation
‍We do not refund membership fees, but we will:
- Offer a rescheduled date whenever possible
- Suggest an alternative activity for your squad
- Membership fees cover more than the activity itself, so cancellations do not result in refunds.

‍5. If You Are Not Matched in a Month
‍
If you submit your availability and we cannot match you that month due to:
- Low member availability in your region
- Scheduling constraints
- Uneven group numbers

This does not qualify for a refund, but we may:
- Prioritize you for the next month
- Suggest additional availability options
- Offer community engagement opportunities during that month

Membership is not activity-guaranteed; it is participation in a community system.

‍6. Special Circumstances
‍
We may, at our sole discretion, offer a refund or credit in exceptional situations, including:
- Documented medical emergencies
- Severe personal hardship
- Administrative error on our side

These cases are assessed individually and are not guaranteed.
We do not provide partial refunds.

‍7. Payment Issues and Chargebacks
‍
If a payment dispute or chargeback is initiated:
- Your membership may be temporarily suspended
- We may request additional information
- We may terminate your membership for abuse of chargeback systems
- Outstanding balances remain your responsibility
- False or abusive chargebacks may result in the Member being permanently banned from Apex Circle.

‍8. Trial Periods, Promotions & Discounts
‍
If Apex Circle offers trial periods, introductory offers, or promotional discounts:
- These are non-refundable
- They do not modify the general refund rules
- Cancellation must occur before the next billing cycle to avoid charges

‍9. Digital Service Acknowledgment
‍
Apex Circle is classified as a digital service with immediate access (EU consumer law).
When you join, you express consent to receiving immediate access to member benefits.
Therefore, the 14-day right of withdrawal does not apply, in accordance with Article 16(m) of the EU Consumer Rights Directive.
